What is it?

Surrogacy is a form of Assisted Reproduction Technology (ART) where a woman (the surrogate) offers to carry a baby through pregnancy on behalf of another person or couple before relinquishing the baby to the intended parent(s) once it is born. For many intended parents, surrogacy is their only hope of having a child. Surrogacy in Western Australia is governed by the Surrogacy Act (2008) and Human Reproductive Technology (HRT) Act (1991).

What is involved?

Surrogacy is a complex process to navigate and there are important clinical and psycho-social considerations that need to be contemplated when undergoing a surrogacy arrangement.

With surrogacy:

  1. Participants need to undergo counselling and medical and psychological assessment to ensure suitability and readiness to a surrogacy arrangement.
  2. Parties must obtain independent legal advice before agreeing to sign a group surrogacy arrangement drawn up by the intending parent’s legal advisor.
  3. An application needs to be submitted to the Reproductive Technology Council (RTC) of Western Australia for approval.

All applications for surrogacy are reviewed by the team, ensuring that our surrogacy program is in accordance with the highest ethical standards.
